1. Introduction

Welcome to TOOTMAP. These Terms and Conditions govern your use of our website and services. TOOTMAP is a high-end Ghanaian network of unconventional creatives offering design, production, publishing, and marketing services.

By accessing or using our website, you agree to be bound by these Terms. If you do not agree with any part of these terms, you must not use our website or services.

2. Definitions

• “You”, “Your” refers to the user or client
• “Services” refers to design, production, publishing, and marketing services
• “Deliverables” refers to work products created for clients

3. Services

TOOTMAP provides creative services including but not limited to:

• Design (branding, graphic design, UI/UX design)
• Production (video production, photography, audio production)
• Publishing (content creation, editorial services)
• Marketing & Advertising (digital marketing, campaign strategy)

Specific terms for each project will be outlined in individual service agreements.

4. Client Relationships

All client engagements begin with a formal agreement or contract outlining scope, timeline, deliverables, and payment terms. By engaging our services, you agree to the terms specified in your service agreement along with these general terms.

5. Intellectual Property

Upon full payment, clients receive ownership or license rights to deliverables as specified in their service agreement. Until full payment is received, all work remains the property of TOOTMAP.

TOOTMAP retains the right to use completed work in our portfolio and marketing materials unless otherwise agreed in writing.

6. Payment Terms

Payment terms are specified in individual service agreements. Generally:

• A deposit may be required before work begins
• Milestone payments may be structured for larger projects
• Final payment is due upon delivery unless otherwise agreed

7. Revisions & Approvals

Each project includes a specified number of revision rounds. Additional revisions beyond the agreed scope will be billed at our standard hourly rate. Client approvals must be provided in writing.

8. Confidentiality

TOOTMAP treats all client information as confidential. We will not disclose, share, or use confidential client information for any purpose other than fulfilling our obligations under the service agreement.

9. Limitation of Liability

TOOTMAP shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to our services. Our total liability shall not exceed the amount paid by you for the services in question.

10. Third-Party Services

Our website may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or terms of any third-party services.

11. Indemnification

You agree to indemnify and hold TOOTMAP harmless from any claims, damages, or expenses arising from your use of our services or violation of these terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Ghana, without regard to its conflict of law provisions.
